By virtue of the customs union decision, Turkey has been exerting efforts for many years to align the customs legislation and information technologies with those of the EU. In this context, by our Decree which took effect on 1st of January 2015, our GSP regime has been harmonized with the EU legislation to a large extent.
At this stage, we have finalized our legislation in parallel with the provisions of the Commission Delegated Regulation No 2015/2446 and Commission Implementing Regulation No 2015/2447. With the publication of Presidential Decree (Decree on Implementation of Statement on Origin for the Goods Benefiting from the Preferential Regime in the Context Of Generalized System of Preferences) on 26 December 2018 (Turkish Official Gazette No:30637). Turkey has fully align its GSP legislation including provisions about Registered Exporter (REX) system.
According to second paragraph of Article 15 of the Decree, the notifications made by Beneficiary Countries to the European Commission will have equal effect on Turkey with regard to implementation of the REX system.
The main objective of the system is to change certification procedure by replacing issuance of Form A certificate of origin with the statement of origin. In this regard, the system will facilitate customs procedures by diminishing certification operations. In addition to that, it will help to increase the importance of administrative cooperation mutually between the exporting country and Beneficiary Countries with the abolishment of certification and approval procedures. Within a certain time period, Form A certificates of origin, EUR.1 movement certificates and invoice declarations will not be used under GSP regime.
To start the implementation of the system, Turkey has conducted necessary studies especially on IT infrastructure in coordination with the European Commission. Turkey has been implementing the system since 2nd of August, 2019, with the publication of Communique in Turkish Official Gazette.
Within the context of the system, it is possible for Turkey to access to the database of the EU, and they will be able to share the data reciprocally while using the system. The exporters in the Beneficiary Countries which complete necessary procedures to be a part of the system will get a registration number from their Customs Administration. To benefit from Turkish GSP regime, they will make a statement of origin instead of issuance of Form A certificate of origin with their registration number by 2 August 2019. To prevent any disorders with the implementation of the system, there will be a three-months transition period for the exporters in the Beneficiary Countries. Within this period, they will be able issue to Form A certificate of origin, or to make a statement of origin.
On the other hand, exporters in the Beneficiary Countries for whom a time-period given by the EU for their integration to the REX system will be able to issue Form A certificate of origin, or to make a statement of origin until completing necessary notification procedure and integrating to the system.
